These terms are the agreement between you and Dargano (“Dargano”, “we”, “us”), covering your use of the Dargano app and website. By creating an account or using the app, you accept them. If you do not accept them, please do not use Dargano.

1. Who may use Dargano

You must be at least 16 years old, or the age of digital consent where you live if that is higher, and legally able to enter into this agreement. You may not use Dargano if we have previously terminated your account, or if the law where you are prohibits it.

2. Your account

You need an account to use Dargano. Give us an email address you actually control, keep your password to yourself, and tell us promptly if you think someone else has access. You are responsible for what happens under your account. One account per person; do not share it.

3. Dargano is not medical advice

This is the most important term in this document.

• Dargano is not a medical device and is not regulated as one. It provides general wellness and self-improvement information only.
• Nothing in the app — no daily suggestion, score, detected pattern, experiment result, weekly review, or message from the AI Coach — is medical advice, a diagnosis, a prognosis, a treatment plan, or a professional opinion of any kind.
• Patterns and experiment results describe things observed in data you entered about yourself. They are not evidence that one thing caused another, and the app is deliberately written never to claim otherwise.
• Never disregard professional medical advice, or delay seeking it, because of something Dargano said.
• In an emergency, or if you are in crisis, contact your local emergency services or a crisis line immediately. Dargano is not a crisis service, is not monitored by clinicians, and cannot respond to an emergency.

You are responsible for deciding whether any suggestion is appropriate for you, and for consulting a doctor before starting or changing anything that affects your health — particularly exercise, diet, sleep medication, or the management of an existing condition.

4. The AI Coach and AI-generated content

Part of Dargano uses artificial intelligence to write replies and suggest experiments. You should know what that means in practice:

• AI output can be wrong, incomplete, or confidently mistaken. Treat it as a starting point, not an authority.
• To answer, we send your message and a summary of your recent wellbeing data to a third-party AI provider, as described in our Privacy Policy. Do not send the coach anything you would not want processed that way.
• Your daily plan is not AI-generated. It is chosen by fixed rules from a pre-written library of actions, which is what keeps the app's suggestions within a reviewed set.
• We may limit how often the AI features can be used, per account, to keep the service available and affordable for everyone.

5. Your content

Everything you put into Dargano — check-ins, habits, notes, reflections, coach messages — remains yours. You grant us a limited, worldwide, royalty-free licence to store, process and display it strictly in order to operate the app for you: to show it back to you, to calculate your scores and patterns, to generate your plan, and to send the summaries described in section 4. That licence exists only to run the service, it is not transferable other than to the providers listed in our Privacy Policy, and it ends when you delete the content or your account.

We do not use your content to train AI models, and we do not publish it.

6. Acceptable use

Do not: use Dargano for anything unlawful; try to access another person's data or any part of our systems you have not been given access to; probe, scan or test our security without our written permission; scrape the service or use it via automated means; reverse engineer or decompile the app except to the extent the law expressly permits; resell, rent or sublicense access; interfere with the service's operation; or use the AI features to generate unlawful or abusive content. We may suspend or terminate an account that does any of this.

7. Dargano Premium (subscriptions)

The core Dargano app is free to use. Dargano Premium is an optional, paid subscription that unlocks the AI Coach, My Experiments, Weekly Review, Patterns and custom sections. Everything else stays free. Dargano contains no advertising.

• Plans. Premium is sold as a monthly plan and a yearly plan. Both renew automatically until you cancel.
• Free trial. New subscribers get a 3-day free trial of Premium; the store decides who is eligible. If you do not cancel before the trial ends, your subscription starts and you are charged the price you were shown when you subscribed.
• Price and payment. The price, in your local currency, is shown by the Apple App Store or Google Play before you confirm. We do not take payment ourselves: you pay through your Apple ID or Google Play account, and the store is responsible for billing, receipts and tax. That store's terms apply to the purchase as well as these terms.
• Renewal. A subscription renews for the same period unless you cancel at least 24 hours before the end of the current period (including the trial). The store charges the renewal within 24 hours before the period ends.
• Price changes. If the price of a plan changes, the store tells you and, where the store requires it, asks for your consent before the new price applies to you. A change never applies to a period you have already paid for.
• Cancelling. You cancel in the store, not in Dargano: on an iPhone, in your Apple ID subscription settings (Settings, your name, Subscriptions); on Android, in the Google Play Store (Payments & subscriptions, Subscriptions). After you cancel you keep Premium until the end of the period you have already paid for. Deleting your Dargano account does not cancel a subscription, so cancel first or the store may keep charging you.
• Refunds. Apple and Google handle refund requests under their own policies, and we cannot refund a purchase made through a store. Your legal rights as a consumer are not affected.
• Restoring Premium. If you reinstall Dargano or sign in on a new device, use Restore Purchases (Profile → Account & Legal → Subscription) to bring Premium back.
• When Premium ends. If your subscription is cancelled and the paid period runs out, or it otherwise ends, the Premium features lock. Nothing you have recorded is deleted: your data stays in your account and stays visible, and you can subscribe again at any time.

8. Availability and changes to the service

We aim to keep Dargano running but we do not guarantee uninterrupted or error-free service. We may change, suspend or discontinue features, and we may need to take the service down for maintenance. If we discontinue Dargano entirely, we will give you reasonable notice and a period in which to export your data.

9. Ending this agreement

You may stop using Dargano at any time and delete your account from within the app (Profile → Account & Legal → Privacy & account → Delete your account → Delete my account). Deletion is permanent, and it does not cancel a subscription bought through the Apple App Store or Google Play (see section 7). We may suspend or terminate your account if you materially breach these terms, if required by law, or if we discontinue the service — and other than for serious breach we will try to give you notice first. Sections 3, 5, 10, 11, 12 and 14 survive termination.

10. Intellectual property

Dargano, its name, logo, design, software and content (other than your own content) belong to Dargano and are protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own personal, non-commercial use. All rights not expressly granted are reserved.

11. Disclaimers

To the fullest extent permitted by law, Dargano is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will meet your requirements, that its suggestions will produce any particular result, or that its output will be accurate.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. If you are a consumer, you have legal rights that these terms do not affect.

12. Limitation of liability

To the fullest extent permitted by law, Dargano will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising out of or in connection with your use of Dargano.

Our total aggregate liability arising out of or relating to these terms or the service is limited to the amount you paid for Dargano Premium in the 12 months before the claim, or GBP 50, whichever is greater.

13. Indemnity

If you use Dargano in breach of these terms or in breach of the law, and that causes a third-party claim against us, you agree to indemnify us against the reasonable costs and damages arising from it. This does not apply to claims caused by our own breach or negligence.

14. Governing law and disputes

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the UK or in the EEA, you keep the benefit of any mandatory consumer protections of your own country and may bring proceedings there. Please contact us first — most things are resolved by email.

15. Apple-specific terms

If you obtained Dargano from the Apple App Store, the following apply. This agreement is between you and Dargano only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Dargano, not Apple, is responsible for addressing any claim relating to the app, including product liability, failure to conform to legal requirements, and consumer protection or privacy claims, and for the investigation and defence of any third-party intellectual property infringement claim. You confirm that you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government prohibited-party list. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

16. General

These terms, together with the Privacy Policy, are the whole agreement between us. If a provision is found unenforceable, the rest continues in force. Our not enforcing a term is not a waiver of it. You may not assign this agreement; we may assign it to an affiliate or to an acquirer of our business. We may update these terms; for material changes we will give notice in the app or by email before they take effect, and continuing to use Dargano afterwards means you accept them.
